Because the Petitioner held an unsuperseded judgment debt which the Respondent failed to satisfy after a statutory demand, there was no bona fide dispute and a presumption of insolvency arose; pending counterclaims and appeals did not prevent winding up; accordingly the Court ordered the Respondent wound up and appointed the Petitioner's proposed joint liquidators.
