The Minister acted beyond jurisdiction by referring the dispute under s.26(2) IRA without there being recognition accorded under the s.9 process; the Industrial Court's finding on recognition by conduct was outside its terms of reference and therefore a nullity; certiorari is granted to quash the Minister's decision.
