The Court held that where booking fees were paid and the transactional documents demonstrated essentials of the bargain, the date of first payment is the commencement date for the 36‑month delivery period; the three ministerial extensions of time relied upon by the defendant are valid and deductible from the LAD computation; challenges to ministerial decisions must be by judicial review or by adding the Ministry as a party; date for calculation of LAD is deemed 30 days from service of notice of vacant possession or actual collection of keys, whichever earlier.
