Given the prosecution expressed intent to consider future prosecution and did not abandon the charge, and the charge as framed met the statutory requirements under s.4(1)(b) Act 613, the court correctly exercised its discretion under s.254(1) KTJ to discharge the accused not amounting to an acquittal; the charge was not groundless and an appeal against a non‑final order of discharge without acquittal is incompetent.
