Appeal allowed: the Court found the Novation Agreement preserved the Main Agreement's original contractual date so the dispute arose under a pre-CIPAA contract and the adjudicator lacked statutory jurisdiction under CIPAA; independently, the adjudicator delivered the adjudication decision one working day beyond the mandatory 45 working days under s.12(2)(a) without agreed extension, rendering the decision void; accordingly the High Court's orders and the Adjudication Decision were set aside and enforcement stayed pending arbitration.
