On the affidavit material the petitioner failed to discharge the statutory pre-condition under s.106(1) LRA 1976 or to produce clear, reliable evidence that the respondent wilfully failed to attend the conciliatory body; the SMS and JPN delivery evidence were doubtful and insufficient. Given the mandatory nature of s.106 and the insufficiency of evidence on the affidavits, the respondent's O.18 r.19 striking out application was allowed and the divorce petition struck out (with liberty to file afresh).
