The application for summary judgment was dismissed because genuine triable issues existed: the 18.9.2020 correspondence evidenced a condition that the RM8.8m cheque be banked-in only upon Defendant receiving payment from the Government, the effect and enforceability of that conditional arrangement (and its interaction with CIPAA s35) could not be resolved summarily, and the Defendant raised a bona fide counterclaim and other factual disputes requiring viva voce evidence and trial.
