The High Court held there was no bona fide question of title sufficient to oust the Sessions Court’s jurisdiction; the applicant’s transfer application lacked merit and appeared intended to delay proceedings; because the matter concerned recovery of possession and did not raise a genuine title dispute the Sessions Court could proceed, and the refusal to transfer was therefore affirmed.
