Applying maximum evaluation the court found prosecution evidence credible and sufficient: drugs were found in a waist bag worn on accused's person establishing physical possession and control; chemical analysis matched methamphetamine and urine analysis showed amphetamine/methamphetamine; chain of custody and laboratory procedures were adequately maintained; statutory presumptions under the Dangerous Drugs Act applied and defence failed to rebut them on balance of probabilities. Therefore accused was convicted on both possession (s.12(2)) and consumption (s.15(1)(a)) charges.
