Applicant's re-appointment was refused and the 2nd caveator appointed sole administrator because the Assignment and Power of Attorney contained express statements evidencing RM375,000 consideration thereby reducing applicant's beneficial interest, and because applicant's past conduct (13-year failure to administer, bankruptcy, surrendering documents, police reports and being personally objectionable to majority beneficiaries) rendered him unfit; under s.30 the court exercised discretion to appoint the person best able to protect beneficiaries' interests.
