The contingency clause providing for legal fees payable only on success (20%) contravened section 112(1)(b) of the Legal Profession Act 1976 and was therefore unlawful and void under the Contracts Act; additionally the plaintiff discharged themselves and thus failed to perform the contract entitling the defendants to terminate and refuse payment of the remaining retainer; consequently the strike out application succeeded and the plaintiff's summary judgment for the retainer balance was dismissed.
