The court held that the correspondence and solicitor letters between the parties objectively established a concluded agreement obliging the defendant to pay an additional RM350,000; the subsequent proposal to reduce to RM200,000 was conditional and did not displace the original obligation, therefore the Sessions Court's grant of the Order under Rule 14A was correct and the appeal was dismissed with costs.
