Appellate court found the Magistrate plainly wrong for failing to properly appreciate evidence that respondent did not remedy the leakages, respondent failed to discharge the onus to prove completion, appellant validly notified respondent and appointed a new contractor, appellant proved costs for remedial works for Lot 3.11 and is entitled to recover RM45,000 plus interest and costs; accordingly, the Magistrate's judgment was set aside and respondent's claim dismissed while the counterclaim was allowed in part.
