The Court found on the evidence that the Plaintiff deposited identifiable monies into the Defendant's personal account for a specific business purpose, the Defendant admitted the purpose and identification of deposits, and failed to rebut by calling material witnesses; accordingly a Quistclose trust was established in favour of the Plaintiff, the Defendant is a trustee liable to account for RMB7,200,337.80, and the Defendant's uninsured counterclaim failed for want of evidence.
