The appellate court found no basis to interfere: the Sessions Court's factual findings that both fibre optic and copper cables were damaged were supported by witness evidence (SP-1, SP-4), photographs and contemporaneous documents; documents marked ID were properly admitted at the end of trial under s.73A(2); the Appellant failed to obtain requisite confirmations/consents as required by DBKL and thus was liable; the award of RM905,716.55 was not in error and the appeal was dismissed with costs.
