Plaintiff failed to prove on the balance of probabilities that the defendants entered an agreement to injure the plaintiff using unlawful means or that the plaintiff would have been awarded the GLV contract if it had tendered; key witnesses were not called giving rise to adverse inference; evidence showed plaintiff lacked required financial capacity and the arrangement provided the plaintiff with revenue; accordingly both conspiracy allegations fail and the claim is dismissed with costs.
