Conviction under s41(1) RTA 1987 set aside because prosecution failed to prove essential elements beyond reasonable doubt: uncertainty whether U-turn was illegal (eyewitness uncertain), post-mortem report inadmissible for failure to prove service and maker not called, identity of the person at scene and causation of death were not established; court substituted conviction to s43(1) RTA 1987 and imposed a fine of RM10,000 or six months imprisonment in default, and ordered bail pending appeal to be returned.
