The Court held the Sessions Court had properly evaluated the evidence and reasonably exercised its discretion under s4(6)(b) Debtors Act 1957 in ordering RM2,500 monthly instalments; the High Court erred in ordering re-examination and discovery and in making inconsistent orders; there were no grounds to draw an adverse inference; accordingly the High Court decision was set aside and the Sessions Court decision restored.
