Defendants failed to prove, beyond reasonable doubt, that a trust existed over the disputed subdivided lots: there was no persuasive money trail linking withdrawals from Wan Ibrahim's Tabung Haji account to credits in the plaintiff's account; the estate/probate did not list the disputed land; and defendants delayed in seeking equitable relief. Accordingly the plaintiff's registered interest is unimpeachable under s 340 KTN and the writ in favour of the plaintiff is allowed.
