The insured failed to prove on the balance of probabilities that the vehicle was stolen (as distinct from merely missing), and also breached conditions precedent (late notification and late claim submission) in the policy; therefore insurer’s repudiation was justified and the appellate court will not disturb the Magistrate’s factual findings which were not plainly wrong.
