The High Court found that service of the writ, statement of claim and default judgment was properly effected so the default judgment was regular; the Appellant failed to demonstrate an arguable defence on the merits; and the Appellant's inordinate delay of one year and two months in applying to set aside the judgment militated against excusing non-compliance with Order 42 r 13 — therefore the appeal is dismissed and costs awarded to the Plaintiffs.
