The disciplinary proceedings were vitiated by breach of natural justice because the investigating officer who had prosecuted the case attended the Disciplinary Committee proceedings, creating a real risk of bias and denying a fair opportunity to meet evidence; therefore the DC's dismissal and the DAC's affirmation are nullities and must be quashed by certiorari, with consequential relief (mandamus for pay as if reinstated).
