The magistrate erred in law and fact by holding there was no basis to recover demurrage/detention from the named consignee; the Bill of Lading imposes liability on the consignee and permits the carrier or its agent to sue for those charges despite privity issues, and the Singapore jurisdiction clause did not bar Malaysian proceedings against the consignee; accordingly the plaintiffs proved entitlement to recover RM73,900 and the magistrate's dismissal was set aside.
