The oppression claim (Enclosure 1) was dismissed because the alleged acts affected the company and all shareholders equally such that the cause of action vested in the company; the proper remedy is a derivative action under s347 and not a personal oppression claim under s346; accordingly the plaintiff’s originating summons under s346 failed and is dismissed with costs.
