Defendants failed to adduce affidavit evidence establishing any bona fide triable issue; contemporaneous documentary evidence (Form E, payroll records, SSM searches and demand correspondence) established a prima facie case that the company incurred unpaid EPF contributions for Sep 2021–Jul 2022 and, under s.46 EPF Act, the directors are jointly and severally liable; therefore summary judgment under Order 14 was appropriate and should be entered for the Plaintiff.
