The court held that the challenge to the travel ban was in substance a challenge to a statutory decision made under s39(1)(a) EPF Act and therefore required judicial review under Order 53; the plaintiffs' originating summons circumvented the proper procedure and they were also out of time, and on the merits the travel ban was validly issued following summary judgment and unrelated to the disclosure request, so declarations were refused.
