The application to withdraw was allowed with liberty to file afresh because the proceeding was at an early stage, the Defendants were not dominus litis, the Plaintiff had not obtained any interlocutory advantage, and the Plaintiff's conduct did not amount to abuse of process; withdrawal was permitted on terms that the Plaintiff pay costs of RM 10,000 to the Defendants before any new suit is filed.
