Prosecution failed to prove a prima facie case because the charge was materially misleading as to location/control, the alleged caution was not proved by words or corroboration such that SP4’s account of accused directing police cannot be safely relied upon, and prosecution did not exclude access by others nor rebut alternative inferences; therefore possession and knowledge were not established beyond permitting a prima facie call to defence.
