Because the Appellants' representations were made before 1.1.2021, s.35 requires proceedings to be governed by the unamended Act; therefore the proper mode to challenge the Industrial Court award is by judicial review and not by appeal under s.33C; the High Court erred in entertaining the appeal and setting aside the Industrial Court award, so the High Court decision is set aside and the Industrial Court award reinstated.
