The originating summons sought to impugn the Defendant's election and therefore fell within the exclusive statutory regime for election challenges under Article 118 and the Election Offences Act 1954; consequently the High Court on an originating summons had no jurisdiction to grant the principal reliefs, the claim disclosed no reasonable cause of action, was frivolous and vexatious and amounted to an abuse of process, and must be struck out under O.18 r.19(1)(a),(b) and (d).
