The applicant failed to establish a prima facie case under section 471 CA 2016 because there was no credible nexus between the respondents and the applicant's disputed debt, Poly Effort lacked any proven legal or beneficial interest in the properties to effect the alleged contra, the critical Poly Effort Letter was of doubtful authenticity due to materially inconsistent versions, and the liquidator had properly and diligently verified and rejected the claim; therefore leave to commence proceedings was refused.
