Article 19(1) of the Sarawak Constitution, read literally and in context with Articles 17(1)(g), 20 and the Federal Constitution (Articles 48,53,118), confines the Dewan's power to decide only post-election (supervening) disqualifications; disqualification incurred before election is a pre-election matter for the Election Court under Article 118 and the Dewan's decision in relation to that pre-election disqualification (Ministerial Motion 12.5.2017) was without jurisdiction and unlawful.
