The High Court upheld the Industrial Court's factual findings that the employer proved genuine redundancy on the balance of probabilities by reference to audited accounts showing losses, commercial necessity to close Plant 2, redistribution/absorption of functions and absence of mala fide; therefore dismissals were lawful and judicial review was dismissed.
