The court accepted the defendants' version (Eksh WZWA-1) as more consistent with contemporaneous evidence (including the location of a wooden house and an electricity bill) and rejected the applicant's inconsistent affidavit assertions; accordingly the court terminated co-ownership under s145 and ordered partition according to Eksh WZWA-1, with consequential registration and apportionment of partition costs according to shares.
