On the balance of probabilities the Court found Plaintiff proved that RM3,500,000 was paid into Defendant 1's account for the alleged operatorship and that Plaintiff validly cancelled the transaction; Defendant 1 is therefore ordered to repay the net sum of RM3,462,000 to Plaintiff. Claims against Defendant 2 and against Defendants 3 and 4 were not proved and are dismissed; all claims for contribution and indemnity by defendants against each other were dismissed.
