Where two competing reconstructions of the accident were both probable, the court apportioned liability equally (50:50). On quantum, the court assessed general damages (below knee amputation RM70,000; surgical scars RM5,000; wasting RM5,000) and accepted the plaintiff's expert evidence that an advanced microprocessor prosthesis was the appropriate and reasonable remedy, awarding RM368,456 for prosthetic cost without deduction for contingencies; interest and costs awarded as set out in the order.
