On the balance of probabilities the court found the road hole was caused by leakage/rupture of an 8-inch water pipe owned by Syarikat Air which undermined the road surface; Syarikat Air was held 80% liable and JKR/road authorities 20% for contributory failures (blocked drainage, lack of lighting, presence of stump); plaintiffs were not contributorily negligent; damages were adjusted accordingly (intracranial bleeding RM30,000, other awards as set).
