On the balance of probabilities the Jacuzzi's anti-vortex cover was missing or dislodged and defendants failed to maintain and inspect it, failed to execute immediate emergency procedure (switch off Jacuzzi) despite proximity of switch and staff duties, and failed to prove adequate, clear and prominent warnings; these failures caused the drowning and defendants are 100% liable; appropriate damages awarded to plaintiffs accordingly.
