The court exercised its discretion under Order 3 r.5 and its inherent jurisdiction to grant the extension because Pinnacle demonstrated genuine intent and reasonable, accidental causes for a short delay; the automatic lapse did not preclude the court from granting relief where the applicant acted in good faith and ultimately effected the payment, which was declared to satisfy the first tranche requirement.
