The Civil High Court lacks jurisdiction to declare that rental proceeds collected prior to the Syariah Court's determination form part of the deceased's estate for faraid; that factual and legal question falls within Syariah Court jurisdiction and must be referred there; accordingly the plaintiffs' originating summons was dismissed and the interim injunction rendered academic.
