The Court of Appeal held that at the leave stage SLS had established threshold locus standi as a public interest litigant under Order 53 r 2(4) and that the challenge alleging omission in the Review Order 2022 (failure to account for 1974–2021 'Lost Years') raised legal issues of constitutional interpretation that were prima facie justiciable; therefore the High Court's grant of leave was correct and the AG's appeal was dismissed, with the matter remitted for full substantive hearing.
