Prosecutorial discretion is not ordinarily subject to judicial oversight but is reviewable if exercised in bad faith for an extraneous purpose or in breach of constitutional rights; the appellant failed to prove bad faith or abuse; forfeiture proceedings do not preclude criminal prosecution; estoppel/legitimate expectation did not bar prosecution given the facts; repealed s30(7) did not confer immunity. Therefore the High Court rightly refused to quash the 146 charges.
