The Court refused the Defendant's application to amend because the Defendant provided no satisfactory explanation for the significant delay between learning of the statutory declaration and filing the amendment, the amendment was filed after the trial dates had been fixed and appeared to be a tactical afterthought to delay trial, and the statutory declaration by a third party did not directly undermine the Plaintiffs' pleaded basis that the Sales and Purchase Agreements were executed at the Defendant's panel law firm; accordingly the amendment was dismissed with costs.
