Leave to commence judicial review was granted because the applicants established prima facie, substantive and arguable grounds that the Freezing Orders may contravene s44(1) AMLA by failing to identify the subject and basis of the investigation; the court can adjudicate the legality of the orders without compelling disclosure of investigation papers, and the fact the orders lapsed does not render the issues academic because damages and other remedies remain available.
