The court convicted OKT3 because the prosecution proved beyond reasonable doubt that (a) the complainant was under 16 and was sexually penetrated, (b) medical evidence corroborated recent vaginal injury consistent with rape, and (c) OKT3 was present and acted in furtherance of the common intention (either by participation or facilitating and not preventing the crime) thereby attracting liability under s.375B read with s.34; mitigating factors were insufficient to avoid a deterrent custodial sentence of 13 years and application to suspend execution was denied.
