The Court held the Attorney General's refusal of consent under s.9 was lawful and not irrational because the applicant failed to obtain recommendation of the existing trustees, there was no evidence of trustee misconduct warranting removal, consent had previously been given to existing trustees, and the AG properly exercised his discretion to protect public charitable trust interests; accordingly judicial review and appeal were dismissed.
