Filing a Notice of Withdrawal of Appeal does not, of itself, terminate the appeal without the court's leave; the High Court retains jurisdiction and may, in appropriate cases, exercise its revisionary powers under s325 CPC to set aside a withdrawal and order that the appeal and revision proceed. Applying those principles, the Court allowed the prosecution's application, cancelled the withdrawal notices and ordered the appeals and revision to be heard with the respondent and counsel present.
