Leave was properly refused because the supporting affidavits regarding the alleged Addendum Order were inadmissible hearsay lacking direct knowledge and, crucially, there was no legal duty under written law or the Constitution imposed on the respondents to confirm or produce any pardons/addendum; therefore mandamus could not issue. The fresh evidence was excluded because it could have been obtained with reasonable diligence and so did not satisfy the Ladd v Marshall test.
