The appeal is dismissed: the RM5,000 was a stakeholder sum held by solicitors not a booking fee so LAD calculation starts from the SPA signing on 30.12.2015; the Housing Controller's extensions of time are valid and, on those extensions, vacant possession was delivered within time; clause 30(3) of the SPA and s22E HDA prohibit release of stakeholder funds to satisfy LAD and the court will not order release, as doing so would breach fiduciary, professional and statutory duties.
