Prosecution failed to establish a prima facie case because (a) procedural requirements were not complied with (only one bottle taken; accused had no genuine choice) contrary to IGSO F103 and KKM guidelines, (b) key prosecution witnesses were found not credible or their evidence rejected due to contradictions and use of impermissible documents, and (c) absence of two material witnesses justified an adverse inference under Section 114(g); consequently accused discharged and acquitted without being called to enter defence.
